emergencies, medical disclaimer, and adverse events

nymble is not a doctor and is not a substitute for in-person care from a licensed healthcare professional. Do not delay or avoid medical care based on service content. The service is not for emergency use. If you have an emergency, including thoughts of self-harm or harming others, contact local emergency services immediately.

Adverse events should be reported to your healthcare provider, product manufacturer, or applicable health regulator. nymble cannot file adverse event reports on your behalf.

definitions

Account: your unique user relationship, distinguished by phone number and linked to a subscriber organization.
Agreement: these Terms and related policies including the Privacy Policy.
Content: service-generated chat content. Your Content is what you submit.
Services: nymble chat engine, software, products, and services.
Subscriber Organization: business customer paying nymble for user access.

nymble accounts

You must be a real person, age 18 or older.
You must reside in Canada or the United States.
You must be under the care of a registered health professional.
You must meet the clinical eligibility criteria in these terms.
A valid phone number is required for registration and verification.

nymble may refuse, suspend, or revoke access where required for legal, safety, or operational reasons.

clinical eligibility

The Services are not suitable for all individuals. You should not use the Service if any of the following apply:

Acute or unstable medical conditions requiring immediate intensive care.
Inability to provide informed consent.
Severe cognitive impairment preventing safe independent use.
Lack of access to licensed healthcare providers.
Unstable mental health conditions requiring frequent intervention.
Rare/unstudied conditions not represented in service datasets.
Severe sensory impairment without suitable accessibility adaptations.
Fundamental unwillingness to engage with AI-supported tools.

privacy and security safeguards

Data handling follows our Privacy Policy and Responsible AI commitments.
Third-party vendors and hosting providers are used for service delivery.
You are responsible for account/device security, including authentication hygiene.
SMS is not end-to-end encrypted; use WhatsApp for more sensitive content.

disclaimer of warranties

The Services are provided "as is" and "as available" without warranties of any kind. nymble does not guarantee uninterrupted service, specific outcomes, error-free operation, or complete accuracy of generated content. Use of the Services is at your own risk.

release and indemnification

You agree to indemnify and hold nymble harmless for claims and expenses arising from your use of the Services or violation of these terms, subject to standard procedural protections.

limitation of liability

To the maximum extent permitted by law, nymble is not liable for indirect, incidental, special, consequential, or exemplary damages related to service use. Aggregate liability is limited to the greater of: amounts paid by your subscriber organization for your use in the prior six months, or CAD $100.

intellectual property

nymble owns the Website and Services, including related intellectual property. You own your submitted content. You grant nymble a license to store, analyze, and process Your Content to operate and improve the Services, including AI and research/development use.

communicating with nymble

By using the Services, you agree to receive communications electronically via email and chat channels. nymble support is provided by email/chat only; no telephone support is offered.

termination

You may cancel in account settings. nymble may suspend or terminate access at any time, with or without cause, subject to applicable law. Certain legal sections survive termination.

changes to the agreement

nymble may update these terms. Material changes are communicated at least 30 days before taking effect. Continued use after notice constitutes acceptance of revised terms.

miscellaneous

These terms are governed by the laws of British Columbia, Canada. Disputes are subject to Vancouver jurisdiction and may proceed through VanIAC arbitration under applicable rules, including individual-claim requirements and class-action restrictions where enforceable.
